Terms of Service
These Terms of Service ("Terms") govern your access to and use of Cropus AI (the "Service"), operated by Cropus AI ("Cropus", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of These Terms
By creating an account or using the Service, you represent that you have the legal capacity and authority to enter into a binding agreement.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.
2. Your Account
You are responsible for:
- providing accurate registration information and keeping it current
- maintaining the confidentiality of your password
- all activity that occurs under your account
Notify us immediately at support@cropus.ai if you believe your account has been accessed without your authorization. We are not liable for losses arising from unauthorized use of your account where you failed to safeguard your credentials.
You may not create an account on behalf of another person without their permission, create multiple accounts to circumvent usage limits or free-plan allowances, or transfer your account to anyone else.
3. The Service
Cropus AI provides AI-powered tools for generating images, video and text content, along with related workspace features. The Service depends on third-party AI models and infrastructure, and specific models, features and capabilities may change, be added, or be removed over time.
3.1 Beta and evolving features
Parts of the Service may be labeled as preview, beta or coming soon. These are provided without any guarantee of availability, performance or continuity, and may be modified or discontinued at any time.
4. Plans, Credits and Payment
4.1 Free plan
We offer a free plan so you can evaluate the Service without payment. Free-plan allowances are set at our discretion and may be changed or discontinued at any time. Free-plan credits do not carry over between periods.
4.2 Subscription plans
Subscription plans include a monthly credit allowance.
- Your credit allowance resets at the start of each billing period.
- Unused subscription credits do not carry over to the next period. They expire when the period ends.
- Your subscription renews automatically each billing period until you cancel.
- Prices are stated at the point of purchase and may change with notice for future billing periods.
4.3 Pay-as-you-go credits (top-ups)
You may purchase additional credits separately from a subscription.
- Purchased top-up credits do not expire at the end of a billing period. They remain in your account until you use them.
- Top-up credits are consumed after your subscription allowance for the period is exhausted.
4.4 Credit consumption
Different operations consume different amounts of credit, based on the underlying compute cost of the model and settings you choose. The estimated cost of an operation is shown before you confirm it. Actual consumption may vary slightly with model runtime.
4.5 Failed generations
If a generation fails due to a technical error on our side or on the side of our AI providers, the credits consumed for that operation are returned to your account. A generation that completes successfully but does not meet your creative expectations is not a failure and is not refunded.
4.6 Insufficient credits
If your balance is insufficient for an operation, that operation will not run. We are not obligated to extend credit or allow negative balances.
5. Cancellation and Refunds
All payments are final and non-refundable. We do not provide refunds for subscription payments, credit purchases, or unused credits.
You may cancel your subscription at any time from your account settings. On cancellation:
- you will not be charged for any subsequent billing period
- your current period continues until its end date
- your credit allowance is not renewed after the current period ends
- any purchased top-up credits remain available in your account

6. Your Content and Generated Output
6.1 Input you provide
You retain all rights to the prompts, images, files and other material you submit to the Service ("Input"). You grant us a limited license to process your Input solely to operate and provide the Service to you.
You represent that you have the necessary rights to all Input you submit, and that your Input does not infringe anyone else's rights.
6.2 Output you generate
You own the content you generate through the Service ("Output"), to the extent ownership is available under applicable law. You may use Output for personal or commercial purposes without paying us any additional fee or royalty.
You should be aware that:
- AI-generated content may not be eligible for copyright protection in every jurisdiction, and the law in this area is unsettled
- other users may generate similar or identical Output from similar prompts, and we make no claim of exclusivity on your behalf
- you are responsible for reviewing Output before you publish or rely on it
6.3 Our limited rights
We do not use your Input or Output to train AI models. We process and store your content only as necessary to deliver the Service to you, as described in our Privacy Policy.
7. Acceptable Use
You may not use the Service to create, upload, or distribute content that:
- sexualizes minors in any way, or depicts child sexual abuse material
- depicts non-consensual sexual content, or sexual content involving real identifiable people without their consent
- impersonates a real person in a deceptive manner, including synthetic depictions ("deepfakes") intended to mislead
- promotes terrorism, violent extremism, or incites violence against any person or group
- harasses, threatens, defames, or targets any individual
- infringes copyright, trademark, publicity, privacy or other rights
- constitutes fraud, deceptive commercial practice, or election disinformation
- provides instructions for weapons, explosives, or other activity that endangers life
- violates any applicable law
You also may not:
- attempt to bypass usage limits, credit consumption, rate limits, or safety filters
- reverse engineer, scrape, or make automated bulk requests to the Service outside a documented API
- resell or redistribute access to the Service without our written permission
- interfere with the security or integrity of the Service or other users' accounts
7.1 Enforcement
We may review content and account activity where necessary to enforce these Terms. We may suspend or terminate accounts that violate this section, with or without notice depending on the severity. Credits associated with a terminated account are forfeited and not refunded.
We report apparent child sexual abuse material to the appropriate authorities as required by law.
8. Service Availability
We aim to keep the Service available but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, third-party provider outages, or circumstances outside our control. We are not liable for downtime, and downtime does not entitle you to a refund or credit.
9. Changes to the Service and Terms
We may modify the Service or these Terms. If we make a material change to these Terms, we will notify you by email or through the Service before the change takes effect for you. Continued use after the effective date constitutes acceptance. If you do not agree, your remedy is to stop using the Service and cancel your subscription.
10. Termination
You may stop using the Service and delete your account at any time.
We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. If we discontinue the Service entirely, we will give reasonable notice where practical.
On termination, your right to use the Service ends immediately. Sections 6, 11, 12, 13, 14 and 15 survive termination.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- the Service will be uninterrupted, secure or error-free
- Output will be accurate, appropriate, original, or fit for any particular purpose
- Output will not resemble content generated by or for other users
AI systems can produce inaccurate, misleading or unexpected results. You are solely responsible for evaluating Output before using it.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
- OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Cropus AI and its operators from any claim, demand, loss or expense (including reasonable legal fees) arising out of your Input, your Output, your use of the Service, or your breach of these Terms or of any law or third-party right.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules.
Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
You and Cropus AI each waive any right to a jury trial and to participate in a class action or class-wide arbitration.
Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.
15. General
- Entire agreement. These Terms, together with the Privacy Policy and Refund and Cancellation Policy, are the entire agreement between you and us regarding the Service.
- Severability. If any provision is held unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
- Force majeure. We are not liable for failure to perform due to causes beyond our reasonable control.
